Booking Conditions
I have set up Xativa Apartments to enable other people to enjoy the house I have converted primarily for my own use. I am a private individual, not a company. So I have tried to keep these conditions simple and straight forward, so that you know what to expect, what is covered and what I expect, and so that we both have some protection if things go wrong. Basically you are staying in my house, and I want you to enjoy your visit, to feel at home and also to treat it as a home. If you have any concerns or complaints, please bring them to me, and my Spanish agent, straight away, so that we have a chance to resolve them. We will do our best to respond positively, and to enable you to enjoy your stay in Xativa.
1. RESERVATIONS
These can be made either via my websites ( www.xativaapartments.co.uk , or www.valenciaaccomodation.com,) or via www.holidaylettings.co.uk , or by direct contact with myself or my Spanish agent. Once a deposit is paid, you can expect to use the flat and/or studios for the period you have booked, and I will expect you to be bound by these conditions. Payment of your deposit will be deemed as approval in full of these conditions by yourself and all members of your party.
2. BOOKING PERIOD,NUMBER OF NIGHTS AND NUMBER OF PEOPLE
The accommodation is reserved exclusively for the persons named in your booking. Additional people may only sleep in the property if you have my prior approval. Pedro is designed for four people, and Anna and Castillo for two each. It may be possible to accommodate one further person in Pedro or Anna, but only by prior agreement. Unauthorised occupancy will result in additional charges of £50 per person per night and forfeiture of your deposit.
I let from a Wednesday to a Tuesday. In the High and Medium seasons there is a minimum booking period of three days. In the low season the minimum booking period is a week/7 days. If you choose to stay for a shorter period, that is fine, but you will need to pay for the minimum booking period. The period of your booking will be as shown on your confirmation, provided that you book within the Wednesday to Tuesday booking period. You can start or finish your booking any day within a booking period, and of course you can take more than one booking period. The price of your booking will be the number of days times the day rate for the season, subject to the minimum booking period.

3. PAYMENT
When making a booking more than 5 weeks prior to your arrival at my house, I will require a deposit of 25% of the total charge, with the balance due five weeks before arrival. If you book within 5 weeks of your arrival, then I will require payment of the full charge, at the time of booking. Payment should normally be by credit card using the secure “Paypal “system on my website, unless you have agreed special arrangements with me.
4. SECURITY DEPOSIT
I will require you to pay a returnable security deposit in cash and in euros to my Spanish agent on arrival, and also to show her your passport. She will return this deposit to you on your departure, less any deductions to cover the cost of replacing or repairing any losses or damage attributable to you or your party. The deposit will be 150 euros for the flat called Pedro, and 100 euros for either Anna or Castillo.
5. CANCELLATION or DEFERMENT
If you have to cancel or defer, I need to receive written or email advice, normally from the person who made the booking. The following charges will then apply, from the date I receive the notice.
More than five weeks – the deposit is forfeited
Less than five weeks and more than two weeks – 50% of the total charge
Less than 14 days and more than two days – 80% of the total charge
Less than two days – 100% of the total charge.
6. CHANGES
I will do my best to help you, but will need to charge £10 per person admin fee for each person/change, plus cancelation charges as above if within five weeks of your booking date.
7. SERVICES INCLUDED
The charges include the following services.
# You will be welcomed on arrival at the house by my Spanish agent, provided you arrive within the hours of 14.00 and 20.00, and confirm your arrival in Spain to her by telephone. We will try to accommodate other arrival times, provided you agree this with us beforehand. She may need to make a charge for late callout.
# You will find a bottle of low alcohol wine in the fridge and a bowl of fruit on arrival. If you need anything further, we will try to accommodate your requests, and she will charge you direct.
# My Spanish agent will have cleaned the flat before you arrive, and will clean it after you leave. We will provide bedlinen and towels for use in the house. Please bring your own beach towels. If you want more cleaning, please discuss this with the Spanish agent when you arrive. There is a full range of cooking equipment, cutlery and china, to enable you to cater for your party.
# The charges include electricity and bottled gas. You may need to change the gas bottles during your stay. There will be no further charges for any visitor or property tax etc.
# You will be met at the departure time you agree with her, at the House, by my Spanish agent, to collect your keys and return your deposit, less any deductions.
The charges do not include transfer to or from the airport, nor the hire of any vehicles, nor any parking facilities.
8. INSURANCE
I will expect you to arrange your own insurance with a reputable company, to cover you, and your party,against cancellation, illness, accident , third party claims, and damage to my house.
9. SUITABILITY AND ACCESS
My house is around 200 years old, and built in the traditional manner. The photos will give you a good picture of the house, with old joinery, old tiled floors, but new beds, and new kitchens, bathrooms and WCs. There are small, old balconies to all of the windows at the front of the house, which are not suitable for small children. Access to each floor is from the one solid but steep staircase at the rear of the house. There is no central heating or air conditioning. The hot water is heated by a boiler fueled by gas bottles, which may need changing from time to time.
Access to the House is from a narrow, residential street, which in turn is in the heart of the old City. You will find it difficult to drive a large car in the old City. Parking is also difficult, though you may be able to park a SMALL car in the street, provided you are careful not to block access to garages, and park very carefully against the wall with your wing mirrors folded in. You should also be aware that the town centre location, and the narrowness of the street, means that there is a fair degree of ambient noise. Please do not add to this, for example by playing loud music. There is very no through traffic, as the street is short and is only used by those who live on it or work nearby. However, some residents do leave early for work, so you may hear them drive off in the morning. And on some feast days and weekends there may be some noise at night from the nearby market square, which tends to be the focus of Xativa’s social life.
Please bear these matters in mind when considering the suitability of the house for your party.
10. SMOKING AND PETS
Please do NOT smoke anywhere in the house, and please do not bring any animals into the house.
11. PROBLEMS AND COMPLAINTS
Please bring any problems or complaints to the attention of my Spanish agent as soon as these arise, using her mobile phone, so that she can attempt to resolve these promptly. Please also inform me by email, using the local internet café, within 24 hours. We will not entertain complaints made more than 24 hours after the event, or which are beyond our control.
12. DISPUTES AND LIMITS OF LIABILITY
In the event of any dispute concerning standards of accommodation or services provided, my liability shall not exceed 150% of the cost of the accommodation booked. I will not accept liability for consequential losses relating to travel or other arrangements made by yourselves or third parties, nor any liability which might arise from actions of persons over whom I have no control.
Please note that if any part of these booking conditions is found to be invalid or unenforceable, the remainder will not be affected and will remain valid. Disputes and enforcement will be governed by English Law and are subject to the exclusive jurisdiction of the English Courts, using the lowest cost method for resolution, in particular the Small Claims Court.
